PJS, great old sh*t

It's late April and the 2015 Ontario Heritage Conference is coming up fast. This year, it's Niagara-on-the-Lake's turn to host.  I was asked to put together an article about it for the local paper, the Niagara Advance.

In writing about Architectural Conservancy Ontario, as it's now known, which with Community Heritage Ontario first started the Ontario Heritage Conference in 2004, I knew I had to mention Peter John Stokes, who had a very long and close association with both ACO and Niagara-on-the-Lake.


For his passion for the place, its architecture and history, Peter has been called the "soul" of Niagara-on-the-Lake.  He and his wife Ann only moved away -- to Port Hope, another place they adored -- within the last years of his life, and I fear this was partly owing to, in their view, unfortunate changes to their beloved town wrought by insensitive development.


Peter died in 2013, the same year that ACO marked its eightieth anniversary.  Led by Kayla Jonas, an editorial team of which I was part put together a book to commemorate this milestone. 80 for 80: Celebrating 80 years of the Architectural Conservancy of Ontario was the result.  The book captures the stories of eighty properties from across the province that ACO has saved or helped to save. It was dedicated to Peter Stokes and I had the honour of writing the dedication:

The last time I saw Peter was at the banquet at the Ontario Heritage Conference in Cobourg in 2011. He was 85 or so at the time but in good form.  I was wearing a favourite heritage button, given to me by a young colleague, which said "I (heart) old shit."  It was discreetly sized -- small -- and one had to get fairly close to make it out.  Peter spotted it and asked what it was.  I moved right up to him so he could read it.  He peered at it for a minute, laughed and said, "Oh, at first I thought it said 'I love old shits!'."


Peter, you old shit, we'll think of you in NOTL next weekend!

A tale of two parts: Part IVs in Part Vs

This is a bit tricky.

The original OHA prohibited Individual (Part IV) designations in a (Part V) district. As far as I can tell, the reason for this was that property owners should not be subject to two designation regimes — both of which were new in 1975 — applying to the same property.  But since Part IV designations took off much sooner than Part Vs, which were slow to be embraced by municipalities, the result over the years was that municipalities wanting an HCD were often faced with the choice of repealing existing individual designations to clear the way for a district, or of having “holes” in the district where district plans and controls would not apply.

The case that really highlighted this issue concerned Port Dalhousie.  In 2001 St. Catharines opted to repeal three Part IVs in Port Dalhousie in preparation for HCD designation. There were formal objections to this, I think by people who were understandably confused by what was going on, and this triggered the Conservation Review Board process.  The Board supported the repeals in 2002, but as a result the HCD was delayed and wasn’t approved until 2004.

To address the issue the OHA was amended in 2002 — as one of the “efficiency” changes made that year — to allow Part IV designations in districts.  (See subsection 41(2) of the OHA.)  The amendment meant that Part IV controls and process would apply to such properties; but it was also expected that, where there was a district plan (not required for HCDs at the time and having the status of a guideline), it would be used to help guide review of alteration/demolition applications for the Part IVs too.

Meanwhile the province was preparing final proposals for the comprehensive amendments to the OHA which became law in 2005.

With changes coming to district designation, especially new requirements for a strong district plan, the policy question about the relationship between Part IV and Part V designations demanded a more sophisticated response than in 1975 and 2002.  Rules were set out for which Part applies.  (See subsections 41(2.1) - (2.4).)

These rules are not well understood in some places.  The policy intention here is to ensure a more uniform and holistic approach, with the new, improved district plans and controls applying to all properties in the district, while at the same time recognizing that municipalities might still wish to designate individual properties in the district under Part IV, for reasons such as recognition, eligibility for Heritage Property Tax Relief and other incentives or for controls on interior heritage features.

Essentially, the law now says that, where you have a Part IV in a Part V, and the district has a plan adopted post-2005, the Part V controls and process apply with respect to alteration, demolition, etc. and the property is subject to the district plan.  The exception is where there is a designation of interior features; for alterations to those features the Part IV process apples.

But if you have an “old”, pre-2005 HCD and plan, then Part IV applies (i.e. the 2002 rules) — until, that is, you update your plan.

Provincial designation -- boon or bust? (part three)

In 2007 the province came THAT close to designating the Lister Block in downtown Hamilton.

The case pitted then-Culture Minister Caroline Di Cocco against Hamilton Mayor Larry Di Ianni and his council who were determined to okay demolition of the building.  The Lister Block was designated by the city but in a sorry state and it was proposed to replace it with a facsimile (and not a perfect one at that)!

But the minister had a big stick not available to her predecessors, who had no choice but to stand by while losses of important buildings piled up — all the way from, in my memory, Harrison Hall in Chatham in 1980 to the Salmoni Building in Amherstburg in 2004.


Since 2006, when provincial designation and the provincial stop-work order were “activated” with the approval of Reg. 10/06, the Lister Block embroglio was the first real challenge to emerge.  The Ontario Heritage Trust confirmed the provincial significance of the building and the question was… would the province act?

This is the thing about big sticks: they don’t necessarily have to be used to be effective.  In the Lister Block case it was very clear the minister was seriously weighing intervention and, faced with that, the mayor backed down, agreeing to the formation of a working group to seriously examine preservation options and to put off the city’s approval of demolition pending the result.  The building was saved and restored, thanks in part to a $7 million investment by the province, and is now a symbol of renewal in Hamilton’s core.

It might be helpful to distinguish between the exercise of a power — actually designating a property — and the strategic “use” of that power to pressure others to act — prodding municipalities or owners to save a threatened structure by warning of provincial intervention.  So, since the Lister Block, what use has been made of the now-not-so-new provincial powers?

Precious little.  To date no properties have actually been designated, even in unorganized territory.  The stop-order power has been used twice, more notably by then-Minister Aileen Carroll whose order stopped the demolition of the Maclean House near Casa Loma in Toronto, giving the city time to designate the property, which has since been restored.  Nor is there much sign of the strategic use of the powers to goad municipalities as mentioned above.  (And, over time, without real exercise of the powers it will become harder to use them this way, since the “threat” of intervention won’t be taken seriously.)

It certainly has not been for want of endangered properties and for calls for the province to intervene.  Alma College in St. Thomas (victim of demolition-by-neglect and a fire caused by vandals), Colborne Street in Brantford (victim of a terribly misguided attempt at “urban renewal”), and the Gore Park buildings in Hamilton (still teetering on the brink as I write this) are some of the big ones that come to mind.

To pleas for intervention the ministry has fallen back on a consistent response: “The Ontario Heritage Act gives all lower tier municipalities the tools they need to identify and protect heritage property should they choose to use them.  … The primary responsibility to identify and protect cultural heritage property continues to rest with the municipality. Provincial designation and stop order powers are not substitutes for lack of action at the local level.” (See http://www.mtc.gov.on.ca/en/publications/InfoSheet_Provincial_Powers.pdf.)

What this says is that the province has chosen to use the provincial powers as “reserve” powers, meaning they are not to be seen as the primary line of defence for provincially significant property.  Rather, municipalities, with their strong demolition control powers, and a closer connection to their communities, are expected to take action to protect these properties.

But this begs the question, just when will the province act? Under what circumstances does it have, if not the primary responsibility, then a secondary one? The answer so far, through a succession of recent culture ministers, has been (virtually) "none."

So why is this the case?  What is wrong?

I am very close to this, having worked on both the legislation and its early implementation, so can’t offer an unbiased answer, but here goes…

On the policy front, I would say that, in the development of provincial designation, there was lack of clarity about how it was to be used, resulting in failure to fully grasp the implications of its use including resourcing needs.

Two views of PD became entwined.  One view — the proactive view — was that provincial designation was closely analogous to municipal designation.  Following this approach, just as the ministry recommends municipalities do, an inventory should be developed to identify specific properties for attention.  For years — indeed even before the Ontario Heritage Act was passed in 1975 — it had been recognized within and outside the ministry that an inventory of provincially significant property would be an invaluable resource and there had been a number of attempts to jump-start it.  (I recall a former colleague doing considerable work on a proposal for this in the early ‘90s.)

As at the municipal level, a provincial inventory would be the basis of a designation program that, over time and in a systematic fashion, would protect those properties worthy of designation (or, in a variant of this approach, would encourage municipalities to designate/protect them instead).

There were “cons” to this approach.  One was double designations (since every property eligible for provincial designation would be eligible for municipal designation), but this could be handled.  A more serious one was the resources, and time, such a mammoth inventory would require.

The other view — the reactive or “reserve power” view — was essentially that the province should step in only where necessary to save a threatened structure.  This approach could work without a provincial inventory, in an ad hoc way, although obviously an inventory would be very useful here too.  What was not fully appreciated, however, was that this approach would involve the minister in eleventh hour and usually confrontational situations, not just with property owners but with municipal leaders.  And that (as we later saw with the Lister Block experience) this might come with funding pressures.

Adding to the fuzzy thinking about the use of PD, there was perhaps a naive expectation that, once the new provincial powers were in place, the resources and incentive programs needed to really make them work would somehow follow.

The problems with provincial designation seem to come down to this: as currently developed the PD “program” tends to set up risk-averse provincial politicians against their municipal counterparts, and give them little to bring to the table in terms of earmarked resources or incentives.

Or, looked at from a different angle, provincial designation, as conceived and resourced, is no match for Ontario's long tradition of decentralized heritage decision-making.

This is not to excuse provincial inaction, but reluctance is understandable!

Much more could be said — hey, this would be a great thesis topic for someone out there!  Seriously.
